Last Will of Col. Adam Konkle

This is the last will and testament of me Adam Konkle of the Township of Clinton in the County of Lincoln and Province of Ontario Yeoman.

 

                I will and desire that all my just debts funeral and testamentary expenses be paid by my Executors out of my residuary Estate as soon as conveniently may be after my decease.  As to my real estate, having heretofore conveyed to my son William, Lots seven, eight and nine in the Fifth Concession of the Township of Grimsby in said County and also the west half of Lot number sixteen in the first concession of the Township of Clinton, together with the broken front in front of the same in said County, and to my son Mathias the homestead being parts of Lots Seventeen, Eighteen and Nineteen in the first Concession of the said Township of Clinton, and the broken front in front of the same, also the Hagar Lot in said Township of Clinton comprising three acres, two roods and twenty-four perches also forty six acres of the North part of Lot number Twenty one in the Fourth Concession of the said township of Clinton, also Lots one two and three in the fifth Concession of the said Township of Grimsby and to my daughter Mary Frances McGregor one hundred acres being Lot letter L in the gore of Grimsby, and to my daughter Maria Smith one hundred acres being the East halves of Lots numbers Eight in the Third and Fourth Concessions of the Township of Clinton.

 

                I now, give devise and bequeath to my son Henry (in addition to the lands deed to him by my son Mathias at my request) the Jeremiah Zimmerman Homestead being part of Lot twenty one in the first Concession of the Township of Clinton containing eighty eight acres be the same more or less, also one acre and upwards of said Lot number Twenty one in the first Concession of Clinton purchased by me from Elijah Ryckman.

 

                To have and to hold to him and his heirs and assigns forever.

 

                I give devise and bequeath unto my Executors hereinafter named, all and singular the north half of Lot number one in the Seventh concession of the said Township of Grimsby, also a certain village Lot owned by me in the Village of Beamsville in said County of Lincoln and that portion of lot number seventeen in the Third concession of the said Township of Clinton deeded to me by John C. Kerr containing five acres and one twentieth part of an acre and all other my Real Estate not specifically devised whatever in possession remainder or expectancy to have and to hold the same unto and to the use of my said Executors their heirs and assigns upon trust as soon as conveniently may be after my decease to make sale and absolutely dispose thereof either by public auction or private sale and at such price or prices as my said Executors may think just and proper with liberty to my said Executors to purchase the same if sold at public auction for their own use.

 

                And also upon trust to do and execute all proper acts and contracts deeds and assurances for carrying such sale or sales into complete effect, the proceeds of such sale to form part of my residuary Estate and as to my goods chattels and personal effects, I give devise and bequeath to my said Executors all my household furniture farming implements and stock and all and every of my personal estate of whatever kind and description (save and except what is hereinafter specifically bequeathed) to sell and dispose thereof to the best advantage and to collect in and realize the same as soon as conveniently may be after my decease, the proceeds thereof to form part and parcel of my residuary Estate.

 

                And I do give devise and bequeath to my son Mathias the family twenty four hour clock, one bureau, the corner cupboard, also one span of horses, one double set of harness, one double wagon, all to be chosen by him as he may think fit, also all the carpets in the house occupied by me on the homestead and all the stoves therein fastened to the floor, also one bedstead and one feather bed two blankets two feather pillows and bolster and bedclothes for the same.

 

                I also do give devise and bequeath to Francis Welsh now residing with me in addition to the lands deeded to him by Mathias, two horses (one of which he now calls his own) one double wagon all to be chosen by him and after Mathias has made his choice, also two cows to be chosen by him.

 

                I also will and direct that Daniel Vansickle now in my employ be maintained clothed and supported during his life by my son Mathias at the Homestead or elsewhere if they cannot agree and for the due fulfillment of this my desire I charge the cost of his maintenance clothing and support upon the share of my Residuary Estate devised to my son Mathias as hereinafter mentioned.

 

                I also give devise and bequeath to my said daughters Mary Frances McGregor and Maria Smith my two gold watches and one silver watch to be divided between them as they may deem fit.

 

                And as to the dower which my wife, should she survive me, may claim in the lands heretofore devised to my said Executors for sale, I desire that my said Executors should compromise such claim for a cash payment so that such lands can be sold free of dower and pay the amount of such dower if agreed on, out of my residuary Estate.

 

               

In process of being typed
