Last Will of Captain Matthias Konkle 1897, born 1818 died 1897, son of Col. Adam Konkle.

I, Captain Matthias Konkle, of the Township of Clinton, in the County of Lincoln and Province of Ontario, Yeoman, declare this to be my last Will and Testament.

 

Firstly: I do hereby nominate and appoint Matthias Konkle Jun. and his son Henry Konkle, both of the said Township of Clinton my Executors of this my last Will and Testament to carry out all my wishes & decrees as hereinafter described.

 

Secondly: I do hereby give, devise and bequeath unto my Grandson Norman Archibald Konkle his heirs Executors and assigns all my real estate in my possession at the time of my decease & to have granted unto him full possession of said estate when he shall have attained the age of twenty one years, subject to conditions hereinafter described.

 

Thirdly: I will & decree that my son John Haun Konkle have full control & possession of my said real estate until his son Norman Archibald Konkle shall have attained the full age of twenty one years, after that, he shall be entitled to a home including everything necessary to make him comfortable, and that my said Executors hold my said real estate responsible for the expenses during my said son's natural life.

 

Fourthly: If my aforesaid Grandson Norman Archibald Konkle decease before attaining the age of twenty one years, then shall my real estate revert to my son John Haun Konkle his heirs & assigns forever.

 

Fifthly: It is my sincere desire that my aforesaid real estate be not sold but, if possible, remain in possession of my relatives in a direct line of heirship.

 

Sixthly: I will & bequeath to my said son John Haun Konkle a span of horses, one sett of double harness a lumber wagon, the wind Mill lately erected, a bedstead & bedding to suit, the box stove in the Hall & the old clock, also a Cow. In each he is to have his choice.

 

Seventhly: I will & bequeath to my said grand son Norman Archibald Konkle my piano, but if he do not live to the age of twenty one then it shall revert to his father John Haun Konkle & his heirs.

 

Eightly: I will & decree that my executors sell the remainder of my personal property, whatever it may consist of at the time of my decease, as soon as they can make it convenient & for the best interest of the estate & of the heirs especially concerned.

 

Ninethly: I will & Decree that the proceeds of the aforesaid sale shall be equally divided among my six daughters or their heirs (if any of my said daughters should die before me) viz, Susan Terryberry, Matilda Schramm, Eliza Jane Shepherd, Mary Catharine Smith, Nancy Henessy & Sarah L Librock.

 

Tenthly: I will & decree that my executors shall give each of my aforesaid daughters the privilege of purchasing any of the said remainder of my personal property at a price that all shall agree at a private sale or at a public sale if they do not agree.

 

Eleventhly: I will & decree that my executors shall (previous to any division or sale of my personal property,) pay out of it all my lawful debts & funeral expenses including a tombstone.

 

In Witness Whereof I the said Captain Matthias Konkle, the testator, have to this my last Will & Testament contained in this & the preceeding sheet of paper, set my hand & seal this Twenty Sixth day of February A. D. 1897.

This is a Codicil to the last Will and Testament of me, Captain Mathias Konkle of the Township of Clinton in the County of Lincoln and Province of Ontario, bearing date the Twenty sixth day of February A. D. 1897.

 

Firstly: I will & decree that whatever moneys I may have at the time of my decease, deposited in the Bank or otherwise secured shall be added to my said personal estate and shall be disposed of by my executors in the same way & manner as directed in my said Will.

 

Secondly: In addition to what has been bequeathed in my said Will to my said son John Haun Konkle, I do hereby give & bequeath to said son whatever claims I may have at the time of my decease on the products of my said farm, or real estate, whether they be grain, hay, straw, roots or fruit: also the following articles viz: My Burglar proof safe, top buggy, seed drill and Bob sled, to have & to hold for his own use & benefit for ever.

 

In all other respects, I do hereby confirm my said Will.

 

In Witness Whereof, I the said Captain Mathias Konkle, the testator, have to this Codicil to my last Will & Testament contained in this sheet of paper, set my hand & seal this fourteenth day of May A. D. 1897.
